Joe Dreitler practices all aspects of trademark, copyright, advertising and internet law, with particular emphasis on counseling, prosecution, transactional and litigation matters, trademark clearance, licensing and advertising law review, unfair competition, false advertising copyright and domain name litigation in the federal courts and before the Trademark Trial and Appeal Board.

Representative Experience

  • Provides legal advice and client counseling on all trademark, copyright, internet, domain name, unfair competition, licensing, joint venture and corporate intellectual property issues, both U.S. and international

  • Represents clients on the trademark, copyright and domain name aspects of global business transactions, including conducting due diligence and drafting of agreements for mergers, acquisitions, divestitures, bankruptcies, licensing of joint ventures, franchises and the establishing and operation of intellectual property holding companies

  • Obtained Temporary Restraining Order and product recall of knock-off of Brittney Spears Curious perfume, Elizabeth Arden, Inc. v. Belcam, Inc. 76 USPQ2d 1747 (DC SD Ohio 2005)

  • Successfully defended Joel Hyatt and Al Gore against efforts to enjoin the launch of their cable channel, Current TV in Current Communications Group LLC v. Current Media LLC, 76 USPQ2d 1686 (DC SD Ohio 2005)

  • Successfully represented defendant in connection with the first case interpreting Section 110(5) exemption of the 1976 Copyright Act with respect to "public performances"

  • Frequent author and speaker on both U.S. and international trademark, unfair competition, licensing and copyright issues

  • Has qualified as and testified as expert witness on trademark law in federal court

  • Assisted on the International Trademark Association amicus brief to the U.S. Supreme Court in the 1995 case of Qualitex vs. Jacobson; co-authored INTA's brief to the Second Circuit Court of Appeals in the case of Warner Vision Entertainment Inc. v. Empire of Carolina Inc., cited with approval by the court in reversing the trial court's decision on the intent to use provisions of the Trademark Law Revision Act

  • Former Associate General Counsel at Anheuser-Busch Companies, Inc.; managed the world's longest running trademark litigation - the 90 year old dispute over ownership of the Budweiser trademark; responsible for international intellectual property matters, including acquisitions, joint ventures, licensed brewing agreements in numerous countries, trademark development, clearance, registration and protection, including counterfeiting; drafted and negotiated trademark and copyright licenses, including sponsorship of the 1996 Atlanta Olympics and the Busch NASCAR racing

  • Represents and counsels businesses and insurance companies by asserting claims and defending against civil actions in courts within and outside Ohio
