Katie Giumenti is a member of the Bricker & Eckler LLP employment and labor group. She practices labor and employment law with an emphasis on defending employers in litigation and administrative charges involving such issues as discrimination, harassment, retaliation, employment at-will, non-compete agreements, employee benefits, employment contracts, defamation, wrongful discharge, and unfair labor practices. Katie counsels employers on compliance with federal and state labor and employment laws, including the ADA, ADEA, FMLA and FLSA, and on workplace practices and procedures, including harassment, terminations, drug and alcohol testing, and employee handbooks and policies.

Representative Experience

  • Practices in federal and state trial courts and courts of appeals and before the Equal Employment Opportunity Commission, the Ohio Civil Rights Commission, and the State Personnel Board of Review defending employers against claims involving discrimination, wrongful discharge, and other areas described above

  • Obtained judgment for food services industry employer in breach of covenant not to compete litigation

  • Favorably resolved extensive gender and age discrimination investigation by the EEOC on behalf of multi-million dollar manufacturing employer

  • Obtained judgments for employers by drafting successful motions for summary judgment in numerous litigation actions involving claims of race, gender, disability, and/or age discrimination

  • Drafted successful motions to exclude certain evidentiary materials in disability discrimination lawsuit against national hotel chain

  • Successfully defended employers to obtain dismissal of EEOC/OCRC charges of race, gender, disability, and/or age discrimination

  • Counsels employers on the application of changes in Ohio's garnishment laws

  • Served as legal counsel to the Ohio Alliance for Civil Justice (1997-1999), a non-profit corporation consisting of more than 200 businesses, medical providers, local political subdivisions, and charitable organizations and their related trade organizations, which was formed to advocate and defend tort reform in Ohio
