Owner’s claims against defaulting and terminated contractor
and its surety
This project involved the construction of a sewer system for a County to service the residents of an existing subdivision (200+ homes). When the contractor encountered difficulties and failed to complete its work on time, Bricker & Eckler LLP was engaged to counsel the County regarding defective work by the contractor, default and termination of the contractor, completion/correction of the contractor's work, and pursuing a claim against the contractor's contract bond. When the surety failed to pay the County's claim, the County filed suit in the Common Pleas Court. Bricker & Eckler LLP investigated and litigated the matter. Before the trial, Bricker & Eckler LLP represented the County in mediation. The case subsequently was resolved.
Owner’s claims for leaking roof constructed nine years ago
and mold
A new middle school was completed in 1996. The School District immediately experienced water infiltration problems and later mold problems. The contractor and roofing subcontractor denied responsibility. In 2003, the School District retained the Firm to represent it. The School District then filed a demand for arbitration against the contractor and its surety. The arbitration was scheduled to commence in November 2005. The case was resolved. The School District is scheduled to replace the roof in 2006.
Owner’s claims against roofing contractors for defective roof
This project involved a multi-year roof replacement program for a facility owned and leased by a Port Authority to a large aerospace firm. During the program, one of the phases of the roof replacement was determined to be defective. When the contractor failed to take responsibility for the defective work, the Port Authority replaced the roof and engaged Bricker & Eckler LLP to recover its cost of replacement along with its legal and consulting expenses. Following a failed mediation, the Port Authority filed suit in the local Common Pleas Court. After extensive investigation and limited discovery, the case was resolved.
