Bricker & Eckler litigators are a distinctive group of seasoned lawyers who represent insurers in a wide variety of cases. Our litigation lawyers have represented large national insurers in state and federal court in class action lawsuits, agent disputes, bad faith actions, subrogation, disputes with policy holders, and many other types of cases.

Securities litigation. Bricker & Eckler represents broker-dealers, registered representatives and financial institutions in a broad range of customer and industry disputes.  This includes litigation in state and federal trial and appellate courts throughout Ohio and arbitrations across the country before the NASD and the NYSE.  Our attorneys litigate individual and class action claims and all manner of broker-dealer litigation involving the following:

  • Claims of fraud
  • Unsuitability
  • Unauthorized trading
  • Churning
  • Failure to execute
  • Sales practice violations

In addition Bricker & Eckler also represents broker-dealers and insurers of securities in administrative and enforcement proceedings, including those before the Ohio Division of Securities.  We also work with our broker-dealer clients on various pre-litigation and regulatory strategies, and offer advice on compliance, finance, employment and other issues facing our clients.


Litigation Experience and Representations

Our recent work includes:

  • Representing large national insurers in class action lawsuits, including disputes involving claims processing, premium reimbursements, and collection of premium taxes.

  • Representing large national insurers in lawsuits in state and federal court involving agent disputes, including disputes relating to agency, commission agreements, and agent termination.

  • Representing large national insurers in disputes with policyholders pertaining to coverage issues, premium charges, and exclusion issues for life, health, financial, and property and casualty products.

  • Preparing coverage opinions to large insurers.

  • Representing a variety of insurance companies in defense of bad faith actions.

  • Representing large national insurers in subrogation actions.

  • Representing large national insurance company in the defense of products supporting individual defined benefit pension plans.

  • Representing large national insurer in dispute with governmental deferred compensation plan relating to market value adjustment provisions included in group fixed annuity contract.

  • Representing broker dealers, registered representatives, and investment product providers in customer and industry disputes before the Financial Industry Regulatory Authority (FINRA) and in federal and state courts relating to the recommendation, purchase, or sale of registered securities.

  • Representing interests of insurers on important policy issues, such as asbestos litigation reform and tort reform, through amicus curiae briefs filed on behalf of insurers and insurance trade associations in the Ohio Supreme Court and Ohio appellate courts.

The Ohio Supreme Court on December 27, 2007 rules in the case of Arbino v. Johnson & Johnson and upholds limitations on damages in general tort actions and on February 21, 2008 in Groch v. General Motors Corp. finding the statute of repose for product liability actions and the subrogation statutes facially constitutional
