H.B. 324 - Club Fees Exemption

Exempts physical fitness facility and recreation and sports club membership fees from the sales tax if the facility or club is owned or controlled by a nonprofit, income tax-exempt organization operated for religious or charitable purposes.

Clarifies and modifies the law relating to disclaimers under the Ohio Trust Code, provides that a limited liability company may be a nonprofit entity, and makes changes regarding certain tax exemptions.

Prohibits the levying of an assessment by the board of directors of a conservancy district on land that is owned by a church within the district unless the governing authority of the church requests that the church's land be subject to the assessment.

H.B. 89 - Charitable Donations
Sponsored by Representative Bill Coley (R-Liberty Township)

Provides persons who donate consumer goods to a charitable agency with qualified immunity from civil liability for harm that allegedly arises because the consumer goods are not fit for use and establishes a qualified immunity from civil liability for certain charitable agencies that distribute perishable food or consumer goods free of charge to individuals in need.

H.B. 48 - Auction Items
Sponsored by Representative Bob Gibbs (R-Lakewille)

Exempts certain tax exempt organizations and schools that sell at auction items donated to them from license and contract requirements for such an auction, requires those organizations and schools to maintain records of the auction for two years and precludes claims against the Auction Recovery Fund for any loss associated with those types of auctions.

Requires the Department of Job and Family Services to pay a nonprofit nursing home that does not participate in the Medicaid program an annual refund.

S.B. 139 - Prevailing Wage
Sponsored by Senator Larrry Mumper (R-Marion)

Permits state institutions of higher education to use either single or multiple prime bidding for public improvement projects; exempts from the Prevailing Wage Law projects constructed by state institutions of higher education and projects constructed by private, non-profit organizations that receive public moneys to construct those projects; and prohibits the Ohio School Facilities Commission from approving school district projects that specify the payment of prevailing wages.

S.B. 102 - Liquor Sales
Sponsored by Senator Robert Schuler (R-Sycamore Township)

Authorizes the F-8 liquor permit to be issued annually to certain nonprofit organizations to allow the sale of beer and intoxicating liquor at specific events that occur throughout the year on public space that the organization manages.
