Ohio’s electricity market is undergoing massive transformation as a result of the recently passed Senate Bill 221. In the future, it will be a key competitive advantage for advanced energy companies, manufacturers, hospitals, municipalities and other large energy consumers to understand both the regulatory structure created by this new law and the new opportunities it creates to participate in the energy marketplace.

Specifically relating to advanced energy matters, we provide the following services:

  • Project Development: Representing energy manufacturers before the Power Siting Board and developing and negotiating tax abatement agreements.

  • Interconnection: Helping buyers and sellers of power navigate the rules of tying into the grid.

  • Smart Meters: Helping your company assess the value of smart meters and understand the importance of time of day pricing.

  • Distributed Generation: Helping you digest the seminal PUCO Case 05-1500, which seeks to help buyers and sellers of power net meter both in front of and behind the grid.

  • Negotiation: Helping distributed generation projects succeed through negotiations with utility companies to avoid onerous “stand-by charges,” which utilities charge customers for power they never use.

  • Energy Contracts: Negotiating energy procurement contracts allowing consumers to properly manage costs and associated risk.

  • General: Energy matters involving real estate, environmental work and permitting.

Bricker & Eckler LLP also works on numerous transactions involving the purchase and sale of electric energy, natural gas and related products and services in restructured and partially deregulated markets. We also serve as general counsel to the Ohio Manufacturers' Association (“OMA”) and represent its interests before legislative bodies and regulatory agencies.
