Justin Ristau is vice chair of the Bricker & Eckler LLP creditor rights & bankruptcy group and a member of the consumer finance & mortgage banking group. He represents financial institutions in matters involving the full range of complex federal, state, and common law issues that arise in the context of consumer financing and residential mortgage lending. In addition to defending complex contested foreclosure actions, Justin defends residential mortgage lenders and servicers against affirmative claims brought in state court, bankruptcy court, district court, and on appeal.

Justin also represents clients in cases involving bankruptcy, bankruptcy litigation, commercial foreclosure, workout and reorganization, usually representing secured and unsecured creditors in bankruptcy cases, adversary proceedings, and bankruptcy appellate proceedings, as well as in pre-litigation workout and state court commercial foreclosure and receivership proceedings.

Representative Experience

  • Defense of financial institutions in litigation pending in state court, bankruptcy court and district court, including contested foreclosure proceedings

  • Representation of secured and unsecured creditors in commercial and consumer bankruptcy proceedings under Chapters 7, 11, and 13

  • Representation of clients in various adversary proceedings in bankruptcy court, including preference and fraudulent transfer proceedings, nondischargeability proceedings, and proceedings to determine the validity and priority of various claims or interests.
