Mary True is a partner in the Bricker & Eckler litigation and intellectual property groups. Her practice includes litigation in federal courts on matters relating to trademark and copyright infringement, trade secret, trade dress, right of publicity, unfair competition and false advertising, as well as enforcement and prosecution actions in the Trademark Trial and Appeal Board, domain name disputes, trademark clearance and registration, licensing and general counseling.
Representative Experience
Successfully defended well-known founders of a youth-oriented cable television channel against efforts to enjoin the launch of their cable channel, Current TV in Current Communications Group LLC v. Current Media LLC, 76 USPQ2d 1686 (DC SD Ohio 2005); currently representing the channel in trademark infringement action currently pending in the District of Minnesota
Representing well-known U.S. shoe company in a false advertising case pending in the Southern District of Ohio
Represented famous cosmetics company in a right of publicity case in Southern District of New York, opposition proceedings before the Trademark Trial and Appeal Board and trademark portfolio matters
Representing Fortune 50 health care company in various opposition proceedings before the Trademark Trial and Appeal Board
Representing famous New York jeweler in opposition proceedings before the Trademark Trial and Appeal Board and on trademark portfolio matters
Obtained a TRO and product recall on behalf of famous cosmetics company on a trade dress matter involving a perfume package design
Has counseled a major media company on disputes with professional sports leagues
Obtained a monetary judgment for well-known luxury goods providers in civil counterfeiting action in Southern District of Ohio
Represented a well known brewing company in a trademark infringement action filed the Southern District of Indiana
Successful prosecution of trademark infringement and dilution claims on behalf of an insurance company against infringers in Florida, Chicago, Texas and Pennsylvania
Successful prosecution of trademark infringement and dilution claims on behalf of an investment company against infringers in Michigan and Delaware
Preparation on an expedited basis of TRO filings in an action involving trademark dilution/tarnishment and cybersquatting for a major fast-food company
Wrote the complaint in the widely publicized suit Online Computer Library Center, Inc. v. 299 Madison Avenue, L.L.C., d/b/a The Library Hotel, Case No. C2-03-816 (S.D. Ohio)
