Designing A Hospital To Minimize Serious Medical Errors:  A Case Study
Hospital planners in West Bend, Wisconsin (outside Milwaukee), decided to build a hospital specially designed to prevent medical error. To learn how they did it, read Maureen Taylor’s case study of the process.

Best Ideas Recap -- In Case You Missed It
Since January of this year, Bricker & Eckler’s Cincinnati-Dayton office has sponsored a monthly “Best Ideas” roundtable, focusing on what experienced owners, design professionals and contractors have learned from their years of construction. Here Ben Hyden brings together the best ideas from all four roundtables. Unless you attended all four—and even if you did—you’ll find something of value here.

Construction-Related Legislation
The 127th Ohio General Assembly has begun. Keep up-to-date with pending construction-related legislation, updated daily.

What the Courts Are Saying . . .
For our hospital construction issue, we chose our first case because the dispute arose from the construction of a medical center. The Federal court in Kansas looked at an issue with broader appeal, though: a subcontractor’s “pass through claims.” Our second case, also from a Federal court (the Northern District of Ohio), deals with a long-running eminent domain dispute. The lone Ohio Court of Appeals case this month comes from Lawrence County and explores one way an employer might be able to recoup some of its losses when its workers’ compensation premiums balloon because of an accident on a construction site. Finally, our fourth case is really an administrative decision from the Occupational Safety & Health Review Commission. The subject? OSHA’s “Multi-Employer Citation policy.”

Holman, Gillis & Shevelow on Construction Documents:  What Are the "Contract Documents"?
Guest author David S. Riddle, P.E., discusses the meaning of the term “Contract Documents” under various standard contracts. You may be surprised to learn that they don’t all agree on what exactly a “Contract Document” is!

Hindsight about Unforeseen Site Conditions . . .
A Rare Successful Type II Differing Site Conditions Claim

Trying to prove that the conditions you encountered are not just different from what the contract promised but even different from what is known and usual can be close to impossible. Sometimes a contractor does pass that test, though, and this month Doug Shevelow, P.E. and Esq., examines one such recent success.

ADR Corner: How To Select a Third-Party Neutral -- The Procedure
If you might ever find yourself having to choose—or having thrust upon you—a mediator or an arbitrator, you will want to read David Riddle’s explanation of how such choices are made.
