What the Courts Are Saying . . .
October’s four cases begin with a recent Ohio Supreme Court decision on what constitutes a “taking.” Then we look at two cases on the same issue—coverage for a contractor as an “additional insured” on a subcontractor’s insurance policy—one decision from the Court of Appeals for Stark County, Ohio, and one from the federal court for the Northern District of Ohio. Finally, we learn what the Court of Appeals for Franklin County, Ohio, had to say about a contractor’s liability when the backup alarm on one of its trucks proved defective after an accident.
