Enforcement and Litigation

Our attorneys are constantly active in administrative and judicial enforcement matters whether before Ohio’s Environmental Review Appeals Commission (ERAC) or in the federal courts. In fact, one of our group members is a former ERAC Commissioner.  We also have negotiated numerous administrative and civil consent agreements encompassing diverse environmental issues. We have successfully defended siting and permitting decisions through judicial appeals, including the Ohio Supreme Court and the United States Supreme Court.

We have defended clients in enforcement actions brought by the Ohio EPA and the U.S. EPA. We also served as both lead counsel and local counsel in government-initiated and private cleanup cases. In addition, we defend clients in citizen suit cases brought under the various environmental statutes.
