April 13, 2023 Proposed Title IX Athletics Regulations

These proposed regulations, which were released for future publication in the Federal Register on April 6, 2023, would propose to amend the Title IX athletic regulations regarding sex-related eligibility criteria for male and female athletic teams.
 

June 23, 2022 Proposed Regulations

These proposed regulations, issued on the 50th anniversary of Title IX, have gone through the notice and comment process, but no final regulations have been released.  While the proposed regulations are not in effect, the commentary may be interesting to understand the potential directions for future Title IX enforcement.

Final Title IX Regulations: Official Version

On May 19, 2020, the Final Title IX Regulations were officially published in the Federal Register with an effective date of August 14, 2020.
 

Final Title IX Regulations: Unofficial Copy Issued May 6, 2020

On May 6, 2020, the U.S. Department of Education released its Final Title IX Regulations, along with approximately 2,000 pages of commentary accompanying the regulations. Various resources were also issued to accompany the regulations, including a Fact Sheet, a Final Rule Overview, a Summary of Major Provisions of the Final Rule, a Comparison to the Notice of Proposed Rule Making and an hour-long Webinar on the Title IX Regulations.

These proposed Title IX regulations will go through notice and comment before final regulations are issued.  
 

The Law – 20 U.S.C. § 1681

This is the key Title IX statute that prohibits discrimination by educational entities and allows for certain exceptions.
 

The Regulations

These regulations, developed by the U.S. Department of Education’s Office for Civil Rights, offer more specific requirements to ensure compliance with Title IX. This page has not yet been updated to integrate the new regulations, effective August 14, 2020.
