Energy generation facility counsel
Represent Apex Power Group before the Ohio Power Siting Board (OPSB) for the proposed Guernsey Power Station, a 1650-megawatt, natural gas-fired energy generation facility. In 2017, the project received approval to construct and operate the facility. Our team continues to provide substantial regulatory, legislative, tax, permitting and real estate counsel. In addition, we resolved issues involving interconnection with the local transmission company and the Ohio Department of Natural Resources.
Unanimous ruling against controversial ballot issue
Represented the Ohio Renal Association and defended against a controversial ballot issue related to the provision of dialysis services, receiving a favorable 7-0 ruling from the Ohio Supreme Court. The petitioners, who represented out-of-state interests, collected signatures to place an industry-altering price control measure in the form of an amendment to the Ohio Constitution on the November 2018 ballot. However, using state-of-the-art technology built by the firm, as well as the experience of numerous attorneys, Bricker's legal team proved that the petitioners violated Ohio law, disqualifying the issue from voter consideration. From reviewing ballots, analyzing petition signatures and serving as county counsel with local boards of elections to researching and analyzing the applicable laws and representing the client before the Court, more than 80 Bricker team members played a role in this substantial victory.
API government affairs and lobbying activities
Represent API-Ohio, a state affiliate office of the American Petroleum Institute in governmental affairs and lobbying activities before the Ohio General Assembly, the Governor’s Office and related statewide executive agencies. The firm has participated in high-profile and successful lobbying efforts regarding proposed legislative changes to the oil and gas severance tax and other oil and gas statutes in Ohio. In addition, we played an active role in numerous rule-makings before the Ohio Department of Natural Resources, including the horizontal well-site construction rules and emergency/incident notification rules. The firm has also been involved in negotiating various rule packages before Ohio EPA, the Ohio Department of Commerce and the Public Utilities Commission of Ohio relating to incident notifications, air emissions from compressors and other facilities, and call before you dig procedures.
Actively represent more than 30 clients before the Ohio General Assembly, state agencies and local government entities. Longtime clients include the Association of Ohio Life Insurance Companies, the Ohio Manufacturers’ Association, the Ohio Association of Physician Assistants and Northeast Ohio Public Energy Council.
Actively assist several insurance companies, including multiple Fortune 500 companies, with questions regarding Ohio Department of Insurance regulations. Combining our knowledge of both the State Department and appurtenant regulations with an appreciation for those federal entities moving into the insurance regulatory space, we represent these companies in negotiations, rate and product filings, and investigations.
Represented a client before the Federal and Ohio Elections Commissions on a variety of election and campaign finance matters.
Assisted a client in understanding state procurement, bid protests and contract requirements.

Advise public hospitals regarding responses to requests for a large number of public records.

Assisted a client with protecting trade secrets and proprietary information when confidential information had to be submitted to public agencies with bid documents, proposals or other materials.

Provided analysis and guidance to business leaders and executives regarding conflicts of interest and other public sector ethical issues that arise when they accept public board or commission appointments.

Provided guidance to a health care client related to operating their PACs, hosting candidate events and corporate participation in the national convention, ballot issue activity or independent election activity.
