Library system renovation and new construction projects
Prepared procurement documents and negotiated contract documents for architect agreement construction manager at risk contracts for renovation and new construction projects for multiple county library system branches. Construction values ranged from $1 to $9 million.
County jail renovation and new construction projects
Assisted with the selection of project delivery models and prepared request for qualifications, request for proposals, design professional agreements and construction contract documents for a variety of new build and renovation projects for county jails. Project delivery models included construction manager at risk, design-build and general contractor. Project values ranged from $3 to $50 million.
Arranged an affiliation between a large, hospital-owned physician group and the faculty practice plan of a state-owned college of medicine
Favorable verdict on behalf of a public client
On behalf of an Ohio municipality, obtained a favorable verdict in a construction-related litigation suit that had a value of over $2.5 million. The city is also entitled to recover its attorney fees.
$1.6 billion development in Warren County
Served as special counsel to a township in connection with a 1,230-acre, $1.6 billion mixed-use development in southwest Ohio. The transaction involved negotiating and structuring a tax increment financing (TIF) program with 22 incentive districts and 8 parcel TIFs, and the establishment of a new community authority to finance the infrastructure necessary to make the development possible.
COTA downtown bus pass program
Assisted the Capital Crossroads Special Improvement District with structuring and creating a process for implementing a program to encourage 43,000 downtown Columbus, Ohio, commuters to bus to work. Capital Crossroads SID is an organization that represents business owners working to keep the downtown area a clean and safe place to work and live. The goals of the bus pass program are threefold: address the limited downtown parking situation, fill vacant offices and improve air quality.
$80 million Water Street development
Represented the City of Dayton in an $80 million private commercial and residential development at Water Street. This development involved the use of TIF and special assessment financing to pay the costs of a 400-unit parking garage and related road improvements.
Design-build renovation project
Prepared request for qualifications, request for proposals and contract documents for a K-12 school district's design-build project.
Waiver of competitive bidding
Prepared resolutions and related documents for projects deemed to be of urgent necessity, including fire alarm and HVAC renovation projects for a K-12 school district.
Ohio Supreme Court representation
Represented the Chief Justice, the lead Disciplinary Counsel and the Director of the Board of Professional Conduct in defending the constitutionality of Ohio’s Code of Judicial Conduct against First and Fourteenth Amendment challenges. Representation included successful merits briefs in the Southern District of Ohio and the Sixth Circuit Court of Appeals.
