Overview

Our team stands as the shield for businesses, crafting innovative and cost-effective strategies to manage and improve their workers' compensation programs. From navigating common claims with precision, to tackling complex issues, we are the partner that employers trust for a secure and thriving workplace.

Bricker Graydon's workers' compensation team brings over twenty years of expertise in advising and representing employers in all aspects of their workers’ compensation programs. We represent both state-funded and self-insured clients ranging in size from small businesses to Fortune 500 companies. Our workers’ compensation practice assists employers during all phases of a workers’ compensation claim, and we strive to provide cost-containment strategies to allow our clients to run safe, efficient, and cost-effective workers’ compensation programs.

Before an Injury

Workers’ compensation claims can be costly for employers, and our advice and counsel to employers often begins before an injury even occurs. The unfortunate reality of doing business is that workplace injuries are bound to occur from time to time. Understanding that employees are our clients' most important assets, we work proactively with employers to ensure that their employees are well trained, safe, and informed about what to do in the event of a workplace injury.

Our services include designing workers' compensation and safety programs with essential injury reporting and investigation documentation, preparing drug testing procedures and drug-free workplace policies, and creating policies that facilitate bringing injured workers back to work as soon as they are medically able. While we cannot always control when an injury occurs, we can help employers design appropriate and defense-oriented policies and procedures to ensure that when and if a claim occurs, the employer is ready and in the best position possible.

After an Injury

We understand that workers’ compensation claims can be time-consuming, complicated, and frustrating for employers. The workers’ compensation system has its own language of acronyms, and navigating the entire process of a workers’ compensation claim from start to finish can be a wild ride to say the least. We understand that operating a business is an employer’s primary concern, so let us help you deal with the details and nuances of navigating the workers’ compensation system.

After a claim is filed, we assist employers with initial claim investigation, claim certification or denial determinations, and everything else that follows. We routinely and exclusively represent employers in issues pending before the Ohio Bureau of Workers’ Compensation, the Industrial Commission of Ohio, and courts throughout the state.

Our team at Bricker Graydon is experienced in all facets of the workers compensation system including common situations such as physical injuries, occupational diseases and exposures, medical treatment disputes, compensation issues such as Temporary Total Disability (TTD), Permanent Partial Disability (PPD), Wage Loss, Salary Continuation, Living Maintenance, and Permanent Total Disability compensation. We also regularly help employers navigate more complex issues, such as death claims, Violation of Specific Safety Requirement (VSSR) claims, third-party subrogation issues, BWC policy disputes, adjudication hearings, fraud investigations, and court appeals.

Related Issues

Workers’ compensation claims often come with an array of other legal and employment-related issues. Our full-service team at Bricker Graydon is well-equipped to assist employers in related employment issues and beyond. We provide a one-stop experience for our clients, and we regularly advise employers in other employment related issues, such as ADA, EEOC, FMLA, and OSHA issues. We are also a full-service firm that is ready to assist your business with any contractual or legal issue that you may face.
