Jeremy Morris weighs in on National Practitioner Data Bank reports

Health care partner Jeremy Morris was recently interviewed by the Emergency Department Legal Letter discussing the implications of a National Practitioner Data Bank (NPDB) report for emergency physicians (EPs). As instances of malpractice payments or actions against a physician’s clinical privileges could trigger a report to the NPDB, EPs should be aware that they have the opportunity to add a statement to the report explaining any information they believe to be missing from the original report. “Before a physician submits a response to a NPDB report, he or she should seek counsel,” Morris advises. “However, the physician must keep in mind that his or her response will be seen by everyone who submits a query,” thus, “[i]nflammatory statements could do more harm than good.”
