Judge Rules that Ohio BWC Owes Employers $860 Million

Earlier this year, a Cuyahoga County trial court ruled that the Ohio Bureau of Workers’ Compensation’s (BWC) Group Rating Program, in effect between July 2001 and June 2009, violated the law. The court ruled in favor of a class of Ohio employers that did not participate in the BWC Group Rating Program during those years. The class includes as many as 270,000 employers.

On Wednesday, March 20, 2013, the court determined that the appropriate amount of damages owed by BWC to these employers is approximately $860 million. BWC is in the process of appealing the decision, so employers that are part of the class should not expect to see any benefit from this decision until the case reaches a final resolution in the courts.
