Overview
Bricker Graydon Wyatt’s Employee Benefits & Executive Compensation team advises employers and plan fiduciaries on the full lifecycle of retirement plans—from design and implementation to ongoing administration, compliance, and correction. We provide practical, business‑focused guidance grounded in deep experience with ERISA, the Internal Revenue Code, and evolving regulatory expectations.
Our attorneys work with plan sponsors, committees, and administrators to help manage fiduciary risk, maintain compliance, and support effective plan governance. We also regularly represent clients in dealings with the IRS, Department of Labor, and PBGC in connection with audits, investigations, and correction programs.
We sponsor multiple pre-approved plans, including for 401(k), profit sharing, 403(b), and defined benefit plans. We also draft and maintain a large number of individually designed plans for clients that have a more customized need.
Our Retirement Plan Services include:
- Designing and advising on qualified retirement plans, including 401(k), profit‑sharing, money purchase, and defined benefit plans
- Drafting and reviewing plan documents, amendments, summary plan descriptions, and related disclosures
- Advising on ERISA fiduciary duties, prohibited transaction issues, and plan governance best practices
- Training retirement plan committees on fiduciary duties and best practices
- Assisting with Form 5500 reporting, audits, and related compliance matters
- Supporting plan corrections under IRS and DOL voluntary correction programs
- Advising tax‑exempt and governmental employers on complex retirement plan rules and operational compliance
- Assisting employers with the termination of defined benefit plans and advising on de‑risking strategies, including annuity purchases and lump‑sum windows, in coordination with PBGC and regulatory requirements
- Representing plan sponsors and fiduciaries in IRS, DOL, and PBGC audits, investigations, and enforcement matters
Whether advising on day‑to‑day plan administration or guiding employers through complex transactions and regulatory issues, our attorneys provide clear, actionable advice tailored to each client’s circumstances.
