On Friday, the U.S. Senate confirmed National Labor Relations Board (the Board) member, Republican James Macy, creating a 3-1 majority. James Macy joins Republicans James Murphy and Scott Mayer, and Democrat David Prouty. There is still one vacant seat on the Board.
It is expected that with a 3-1 majority, the Board may reconsider several decisions and/or guidance that came out during the Biden administration, including:
- Severance agreement restrictions
- Workplace and handbook decisions
- Union recognition
- Mandatory meetings from management during union campaigns
- Independent contractor decisions, among others
Macy is a management-side attorney, representing businesses for 40 years, who also serves as an administrator at the Department of Labor. Macy will serve a five-year term expiring August 27, 2030.
