On March 15, 2022, the Consolidated Appropriations Act, 2022 was enacted into law. This spending bill extends certain telehealth waivers permitting patients to be located in their homes and other settings in order to receive telehealth services, allowing rural health clinics to be designated “distant sites” eligible for reimbursement for telehealth services, expanding the types of practitioners eligible to provide telehealth services from distant sites, and modifying in-person requirements related to telehealth mental health services. Telehealth waivers will be available for 151 days following the termination of the COVID-19 public health emergency. Congress will need to take additional legislative action to further extend or make the telehealth waivers permanent.
