Client Update: Proposed Changes to Stark and Anti-Kickback Regulations

On October 9, 2019, agencies in the U.S. Department of Health and Human Services (HHS) coordinated the release of proposed changes to the regulations promulgated pursuant to the federal Anti-Kickback Statute (AKS), the civil monetary penalty (CMP) Law, and the physician self-referral law or "Stark Law." HHS' Office of Inspector General (OIG) proposed to significantly expand the safe harbors under the AKS and revise the regulations under CMP Law.
